The National Prosecuting Authority says it is not aware of any court papers being filed to stop the re-enrolment of the extortion case of taxi boss Joe “Ferrari” Sibanyoni and his co-accused.
The case is due to be re-enrolled in the Delmas Magistrate’s Court in Mpumalanga this Thursday morning.
The matter was struck off the court roll in the Kwaggafontein Magistrate’s Court last week.
Chief Magistrate Tuletu Tonjeni struck it off the roll in the Kwaggafontein Magistrate’s Court following state prosecutor Mkhuseli Ntaba’s failure to appear.
Tonjeni found Ntaba in contempt of court and issued a warrant for his arrest. The National Prosecuting Authority has since applied for leave to appeal the ruling against the prosecutor.
